Right of withdrawal

  • According to the Consumer Rights Protection Law of the Republic of Latvia, the Buyer can exercise the right of withdrawal and unilaterally withdraw from the distance contract within 14 calendar days and return the product purchased in the e-store to the Company.
  • The term for exercising the right of withdrawal counts from the day the Buyer has received the product or a part of the product (products) (in cases where the order was partially fulfilled).
  • The buyer cannot use the right of withdrawal if:
  • Buyer has opened any media packaging.
  • According to the sixth part of Article 12 of the Law on the Protection of Consumer Rights, the consumer is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal. The company reserves the right to refuse the Buyer to exercise the right of withdrawal or to withhold a compensation fee in case the product is damaged, careless handling of the product during use or failure to follow the instructions, if the product's original packaging is lost or if its packaging is significantly damaged.
  • To use the right of withdrawal, you must send an e-mail to info@darbnicaskaistumam.lv about the decision to withdraw from this contract.
  • In order for the deadline for the right of withdrawal to be respected, it is sufficient if you send your notification about the exercise of the right of withdrawal before the expiry of the right of withdrawal.

Consequences of refusal:

  • If you cancel this contract, we will refund to you all payments received from you, including delivery costs (excluding additional costs incurred because you have chosen a delivery method other than the cheapest standard delivery method offered by us), without unreasonable delay and in any case no later than 14 days from the day on which we were informed of your decision to withdraw from this contract. Refunds will be made using the same payment method you used for the original transaction, unless you have expressly agreed otherwise. In any case, you will not be charged any fee in connection with such refund. We may withhold the refund until we have received the goods back or you have provided proof that the goods have been returned, whichever comes first, and after we have verified the technical and visual condition of the goods.< /li>
  • You must send back the goods without undue delay and in any event no later than 14 days from the day on which you notified us of your decision to withdraw from this contract. The deadline will be met if you send the goods back before the 14-day deadline.
  • When returning the purchased item, the buyer must present the Buyer's identity document and a document confirming the purchase.
  • You are only responsible for the decrease in the value of the goods, if the goods were used for other purposes than to establish the type, characteristics and operation of these goods. For example, the product(s) is physically or visually damaged, used and/or worn out (the product or its component, component) by more than 5% (five percent).
  • The consumer is responsible for maintaining the quality and safety of the product during the period of exercise of the right of withdrawal (including the complete and perfect preservation of the packaging).

Opt-out of digital content:

  • The consumer cannot refuse digital content, the delivery of which has started - if the delivery of digital content within the right of refusal period:
  • is initiated with the express consent of the consumer and
  • the service provider has received confirmation of the loss of the right of refusal
  • The consumer can refuse digital content whose delivery has not started.
  • The consumer cannot use the right of refusal:
  • 20.05.2014. In the cases specified in Clause 22 of Cabinet of Ministers Regulation No. 255 "Regulations on distance contracts", including if:
  • the price of the item depends on the fluctuations of the financial market, which cannot be controlled by the seller and which may occur during the right of withdrawal;
  • goods are made to the consumer's instructions or are clearly personalized;
  • the consumer has opened the package for the product and/or the security seal is damaged;
  • the product, due to its characteristics, is irreversibly mixed with other things after delivery;
  • the consumer has opened the packaging of the audio recording or video recording or computer programs;
  • the product is mechanically and/or visually damaged, the value of the product has decreased;
  • a contract is concluded for the supply of digital content, which is not supplied on a permanent data carrier, if the supply of digital content has been initiated with the consumer's prior express consent and confirmation of the loss of the right of refusal;
  • if the product has been used in a way that is incompatible with the principle of good faith, including used for a purpose other than to clarify the characteristics or operation of the product.

 

When returning the purchased item, the buyer must present the Buyer's identity document and a document confirming the purchase (for example, the original receipt).
